Here are some examples of our most recent Reported Cases, all of which have had far reaching effects on various aspects of Immigration law, procedure and practice in the UK.
Akyuz and Ozturk v Secretary of State for the Home Dept. European Court of Justice 2008
In this case the European Court made a decision in our client's favour which resulted in establishing the rights of Turkish nationals to switch within the UK from student to employment category. This case led to fundamental changes in the UK for the rights of workers who had been in the UK as students.
Beoku - Betts v Secretary of State for the Home Dept. House of Lords 2008
The judgement of the Law Lords in our clients favour had hugely significant consequences as it established a general Principal of Law that the rights of family members could be taken into account in the Human Rights Appeals process.
Dudau, Mantai, et al v Secretary of State for the Home Dept. High Court 2008
Following the accession of Romania and Bulgaria to the EU we instigated this Class Action against the Secretary of State, the result of which led to an amendment of the Statutory Instrument extending employment rights to dependants.
TB [Jamaica] v Secretary of State for the Home Dept. Court of Appeal 2008
In this case, Judgement of the court was given in our clients favour determining what amounts to an Abuse of Process by the Secretary of State.
Kacaj v Secretary of State for the Home Dept. Court of Appeal
Following the incorporation of the ECHR 2000 into domestic law, ours was the first case to establish the correct standard of proof to be applied by the courts in determining Human Rights Appeals.
